The agreement between Qrambl and the restaurants that use it: your account, the subscription, your content and what each of us is responsible for.
Draft awaiting legal reviewThis text describes how Qrambl works today but has not been reviewed by a lawyer yet. Details in [brackets] are still to be filled in.
The agreement
These terms are an agreement between you and [Legal entity name] ("Qrambl") for the use of qrambl.com, the Qrambl apps and the API. By creating an account or using Qrambl, you accept them. If you sign up for a business, you confirm that you may accept them on its behalf.
Guests who scan a QR code to view a menu or order don't need an account: their order is with the restaurant, not with Qrambl.
The service
Qrambl lets restaurants publish menus, take orders by QR code and takeaway link, run a kitchen display and manage staff, tables and reservations. We improve the service over time; if a change removes a feature you rely on, we will tell account owners in advance.
Your account
You must be at least 18 and able to enter into a contract.
Keep your details accurate and your password secret. You are responsible for what happens under your account and the accounts of the staff you add.
Owners decide who joins their restaurant and with which role. Remove people who should no longer have access.
Free trial and subscription
Your free trial starts when you create your first restaurant and lasts for the length shown when you sign up. It covers every restaurant on your account and is offered once per account. No card is needed to start.
After the trial, each restaurant needs a subscription to stay active: $20 per month per restaurant, unless a different price is shown when you subscribe. Taxes may be added where they apply.
Subscriptions paid by card are billed monthly in advance through Stripe and renew automatically until you cancel.
You can cancel at any time. The subscription then stays active until the end of the period you paid for and is not renewed. We don't refund partial months, unless the law requires it.
If you pay in cash or another offline way, we activate the subscription for 1, 3, 6 or 12 months. It ends at the end of that period unless you renew it.
If a card renewal fails, the restaurant keeps working for 7 days while you update your payment details. After that, it is paused until the subscription is paid.
We may change our prices. We will email you at least 30 days before a new price applies to your subscription, and you can cancel before then.
Payments from your guests
Qrambl takes no commission on your orders. Guests pay you directly: in cash, by card at your counter, or through the payment options you list.
Card payments for takeaway orders are optional. They run through Stripe, in your own Stripe account, as direct charges: the money goes from the guest to you, and Qrambl never holds it or takes a fee. You pay Stripe's fees and handle refunds, disputes and chargebacks.
You are responsible for your prices, taxes and receipts, and for refunds to your guests.
Your content and your guests' data
Your menus, photos, logo and other content stay yours. You allow us to host, copy and show them as needed to run the service, including on your public restaurant page and in search results once you publish it.
You are responsible for your content being accurate and lawful, including prices and allergen and dietary information.
You are responsible for your guests' data under data protection law, including telling them how you use it. We process it for you as described in our Privacy Policy.
Acceptable use
Don't use Qrambl to:
break the law, sell goods or services that are illegal where you are, or mislead guests;
access accounts or data that aren't yours, probe or overload the service, or get around its limits;
upload content that infringes someone else's rights or contains malware;
resell, copy or reverse engineer the service, except where the law allows it.
Cancelling and closing accounts
You can stop using Qrambl and cancel at any time. To delete your account and its data, email us.
We may suspend or close an account that breaks these terms, puts the service or other people at risk, or stays unpaid. Where reasonable, we will warn you first.
When an account is closed, we delete its data as described in our Privacy Policy, except records the law requires us to keep.
Availability
We work to keep Qrambl running, but it may be interrupted for maintenance or by problems outside our control, such as internet or provider outages. Keep a way to take orders without it, such as a printed menu.
Liability
Qrambl is provided "as is". To the extent the law allows, we make no promises beyond those in these terms.
To the extent the law allows, Qrambl is not liable for indirect losses, such as lost profits or lost orders, and our total liability for any claim is limited to what you paid us in the 12 months before it.
Nothing in these terms limits liability that the law does not allow to be limited, or your rights as a consumer where they apply.
Changes to these terms
We may update these terms. We will post the new version here and, for significant changes, email account owners at least 30 days before they apply. If you keep using Qrambl after that, the new terms apply; if you don't accept them, you can cancel.
Governing law
These terms are governed by the laws of [country or state]. Disputes go to the courts of [city and country], unless the law of the country where you live gives you the right to use its courts.
